本規約は日本語と英語で作成されています。日本語版と英語版の間に解釈の相違または矛盾が生じた場合には、英語版が優先されるものとします。
This Agreement is executed in both Japanese and English. In the event of any discrepancy or conflict between the Japanese and English versions, the English version shall prevail.
アフィリエイト（パートナープログラム）利用規約

本規約は、"FXRoyalCashBack"（以下「本サービス」）が提供するパートナープログラム（以下「本プログラム」）と、本プログラムを利用する者（以下「アフィリエイター」）との利用条件を定めるものであり、本プログラムの利用に関して生ずるすべての関係に適用されるものとします。
第１条（アフィリエイター登録）
1. 本プログラムの利用を希望する者は、本規約の全てに同意した上、本サービスが定める方法により登録するものとします。
2. 本サービスはお１人様につき１アカウント限りでのご利用とさせて頂きます。
3. アフィリエイターは、登録内容に変更があった場合には、速やかに所定の変更届出を行うものとします。
第２条（アフィリエイト報酬の発生条件と消滅）
1. アフィリエイト報酬は、アフィリエイターに紐づいたユーザーが本サービスを有効に利用している場合にのみ発生します。
2. 本サービスを退会したユーザー（紹介先）に紐づくアフィリエイト報酬は、退会日以降、理由の如何を問わず発生いたしません。
3. アフィリエイターが本プログラムを退会した場合、すべてのユーザーとの紐づけは即時にリセット（解除）されます。 また、退会時点での未払い報酬残高は放棄したものとみなし、支払われることはありません。
第３条（紐づけの解除）
1. ユーザー（紹介先）が、本サービス内で個別に提供される「特別キャッシュバック」を設定した場合は、当該ユーザーとアフィリエイターのアフィリエイト紐づけは自動的に解除されます。 これに伴う報酬の補填等は一切行いません。
第４条（報酬の支払い）
1. アフィリエイト報酬の支払いは、確定報酬の合計額が 5,000円に達した場合に行われるものとします。
2. 報酬額が最低支払額に満たない場合は、翌月以降へ繰り越されるものとします。
第５条（禁止事項）
アフィリエイターは、以下の行為を行ってはならないものとします。
1. 自身の報酬率を上げることを目的として、ユーザーに対しキャッシュバック率の引き上げを煽る、または過度な期待を抱かせる情報を発信する行為。
2. アフィリエイト報酬の引き出しは、アフィリエイター登録された御本人の口座のみとなります。他人名義の口座（家族名義を含む）への支払申請が行われたことが発覚した場合、当該報酬受領権はすべて無効となり、アカウントおよび報酬は即時に凍結されるものとします。
3. 当社の名称やロゴを、あたかも「公式」や「公認」であると誤認させるような名称でSNSアカウントやウェブサイトを運営する行為。
4. 当社が指定する商標（サービス名等）を用いた、検索エンジンにおけるリスティング広告の出稿（商標キーワード広告）。
5. 法令に違反する行為、または公序良俗に反するサイトでの紹介。
6. その他、当社が不適当と判断する集客行為。
第６条（不正行為と調査中の支払保留）
1. 当社が不正と判断する集客（スパム、虚偽情報の掲載等）は報酬対象外となります。
2. 紹介されたユーザーが、不正な取引（利用規約違反等）によって得たキャッシュバックに関連する報酬は、一切支払われません。
3. 当社は、アフィリエイターに不正の疑いがあると判断した場合、調査が完了するまで報酬の支払いを一時停止できるものとします。 調査の結果、不正が判明した場合は当該報酬の権利を剥奪します。
第７条（広告表記と責任）
1. アフィリエイターは、自身のメディアで紹介を行う際、法令を遵守するものとします。
2. アフィリエイターが掲載した内容に関し、第三者からクレームや異議申し立てを受けた場合、アフィリエイターは自己の責任と費用でこれを解決するものとし、当社に対し一切の損害を与えないものとします。
第８条（免責事項）
1. 当社は、提携先ブローカーの規約変更やサービス終了によって生じたアフィリエイターの損失について、一切の責任を負わないものとします。
2. 提携先ブローカーが当社へのリベート支払いを行わなかった場合、当社はアフィリエイターへの報酬支払い義務を免れるものとします。
3. 当社は、国内外の金融機関による規制、コンプライアンス上の調査、送金システムの不具合、国際情勢に起因する送金制限、または当社の銀行口座の凍結・閉鎖等、当社の責に帰すべからざる事由により報酬の送金に支障が生じた場合、当該支障が解消されるまで支払いを保留し、または支払不能による損害について一切の責任を負わないものとします。
第９条（規約の改訂）
1. 当社は、アフィリエイターの了解を得ることなく本規約を変更できるものとし、変更後の規約は本サイト上に表示した時点より効力を生じるものとします。
第１０条（管轄裁判所）
1. 本サービスに関して当社とアフィリエイターまたは第三者間で紛争が生じた際には、セーシェル共和国の裁判所（Courts of Seychelles）を第一審の専属管轄裁判所と致します。
Affiliate (Partner Program) Terms of Service

These Terms of Service (hereinafter referred to as the "Agreement") set forth the terms and conditions between "FXRoyalCashBack" (hereinafter referred to as the "Service") and the person using the Partner Program provided by the Service (hereinafter referred to as the "Affiliate"), and shall apply to all relationships arising from the use of this Program.
Section 1 (Affiliate Registration)
1. Persons wishing to use this Program shall agree to all terms of this Agreement and register in accordance with the methods prescribed by the Service.
2. Only one account is permitted per person for this Service.
3. Affiliates shall promptly notify the Service of any changes to their registration details.
Section 2 (Conditions for Occurrence and Expiration of Affiliate Rewards)
1. Affiliate rewards are generated only when a user linked to the Affiliate is effectively using the Service.
2. Affiliate rewards linked to a user (referee) who has withdrawn from the Service will not be generated after the withdrawal date, regardless of the reason.
3. If an Affiliate withdraws from this Program, all links with users will be immediately reset (released). Also, any unpaid reward balance at the time of withdrawal shall be deemed waived and will not be paid.
Section 3 (Release of Linking)
1. If a user (referee) sets up "Special Cashback" provided individually within the Service, the affiliate link between the user and the Affiliate will be automatically released. No compensation for rewards will be made in connection with this.
Section 4 (Payment of Rewards)
1. Payment of affiliate rewards shall be made when the total amount of confirmed rewards reaches 5,000 JPY.
2. If the reward amount is less than the minimum payment amount, it shall be carried over to the following month or later.
Section 5 (Prohibited Acts)
Affiliates shall not engage in the following acts:
1. Acts of disseminating information that incites users to expect an increase in cashback rates or creates excessive expectations, for the purpose of increasing their own reward rate.
2. Withdrawal of affiliate rewards is limited to the account of the person registered as the Affiliate. If a payment request to a third-party account (including family members) is discovered, the right to receive such rewards shall be voided, and the account and rewards shall be frozen immediately.
3. Operating SNS accounts or websites with names that mislead others into believing they are "official" or "certified" by using the Service's name or logo.
4. Placing listing ads on search engines using trademarks designated by the Service (service names, etc.) (Trademark Keyword Advertising).
5. Introduction on sites that violate laws or public order and morals.
6. Other customer attraction acts deemed inappropriate by the Service.
Section 6 (Fraudulent Acts and Payment Hold During Investigation)
1. Customer attraction deemed fraudulent by the Service (spam, posting false information, etc.) is not eligible for rewards.
2. Rewards related to cashback obtained by referred users through fraudulent trading (violation of terms of service, etc.) will not be paid at all.
3. If the Service determines that there is a suspicion of fraud by an Affiliate, the Service may suspend payment of rewards until the investigation is completed. If fraud is found as a result of the investigation, the right to such rewards will be revoked.
Section 7 (Advertising Representation and Responsibility)
1. Affiliates shall comply with laws and regulations when making introductions on their own media.
2. If an Affiliate receives a claim or objection from a third party regarding the content posted by the Affiliate, the Affiliate shall resolve this at their own responsibility and expense, and shall not cause any damage to the Service.
Section 8 (Disclaimer)
1. The Service shall not be liable for any losses incurred by Affiliates due to changes in terms or termination of services by partner brokers.
2. If a partner broker does not pay rebates to the Service, the Service shall be exempt from the obligation to pay rewards to the Affiliate.
3. The Service shall not be liable for any delay or inability to remit rewards due to regulations by domestic or international financial institutions, compliance investigations, system failures, restrictions on remittance caused by international affairs, or the freezing/closure of the Service’s bank accounts due to reasons not attributable to the Service. The Service may suspend payments until such issues are resolved.
Section 9 (Revision of Terms)
1. The Service may amend this Agreement without obtaining the Affiliate's consent, and the amended Agreement shall take effect from the time it is displayed on this website.
Section 10 (Jurisdiction)
1. Any dispute arising between the Service and the Affiliate or a third party regarding the Service shall be subject to the exclusive jurisdiction of the Courts of Seychelles in the first instance.
